The terms and conditions indicated below regulate the conditions of ticket sales for the NITS DE VIVERS event promoted and organized by BANCANVAL with C.I.F. B56708944 and address at CALLE SUECA 61 PTA 13 46006 VALÈNCIA (VALENCIA) with email [email protected].
The Organization reserves the right to modify these General Conditions, prior to their publication by this same means, with the User being responsible for their proper reading at the time of each access and/or use.
The acquisition of the ticket and subscription represents the acceptance of the following conditions:
01. YOUR TICKET
1.1 The legal nature of the entry is that of a security, in accordance with the provisions of current legislation. There are 2 types (2) of entry for NITS DE VIVERS.
I) General Admission:
Grants the right to access the concert area during the day of the purchased concert belonging to the Cycle and at the indicated time.
II) Frontstage entrance or first rows:
Grants the right of access to the concert area located in the first rows with respect to the stage during the day of the concert acquired belonging to the Cycle and at the indicated time.
However, the Organization reserves the right to put new types of tickets on sale not contemplated in this point. In any case, said tickets will be subject to the general conditions of sale of tickets and access to NITS DE VIVERS set out in this document. The prices of the different types of tickets and expenses linked to their acquisition are detailed in the TICKETS section and the ticket purchase process.
02. SUSPENSION, CANCELLATION OR CANCELLATION OF THE ACT
Before purchasing tickets for NITS DE VIVERS, it is important that you know the return and refund conditions.
2.1 Once the ticket has been purchased, according to current regulations on consumption and retail trade management, the user will not be able to exercise the right of withdrawal or resolution since the supply of services related to leisure activities is exempt from such right. .
2.2 The user will have the right to a total or partial refund of the ticket price, without including the management costs added to the ticket price in the purchase process, in the event that the festival is suspended or substantially modified, except in those cases in which the suspension or modification occurs once the festival has begun and is due to force majeure.
2.3 In the event that there is any case of total or partial refund of the ticket amount, the user may request a refund within a period of no more than fourteen (14) days from the date of public communication of the cancellation or from the time indicated by the organization, through the technical processes established by the organization.
2.4 The Organization, as the entity in charge of holding the event, may alter or modify the Festival program only when this is necessary for its correct celebration, and especially, when there may be changes in the schedule of the performances, or of the artists. , with prior notice to attendees; and, in any case, for duly justified reason(s) for reasons beyond the control of the festival, such as, for example, but not limited to: the cancellation of the performance of some artist(s) by of the latter unilaterally, the change of day of the performance of one or more artists by the latter unilaterally, due to the manifest impossibility of carrying out the performance of some artist(s) on the day scheduled by circumstances unrelated to the concert; All of this always in accordance with the provisions of current legislation and with respect to consumer and user regulations and, where applicable, in accordance with these general conditions, which will always be interpreted in accordance with the legislation.
In the event that any of the aforementioned assumptions or modifications occur, the Organization will make its best efforts and put all possible means at its disposal to adjust the schedules and carry out the announced concert program.
2.5 The amount of the ticket will not be refunded in the event of cancellation of the festival due to force majeure. Force majeure means what is established by the Spanish Civil Code and the jurisprudence of the Spanish courts and tribunals and, in particular and without limitation, natural disasters, earthquakes, floods, labor disputes, strikes, war (declared or not), rebellion, shortage, shortage of or unforeseeable delay in the supply of raw materials or necessary goods, fires, explosions, emergencies, accidents, or breakdown of essential machines, equipment or tools, action or omission of public services or administration, sabotage , embargo, disturbances of any kind that seriously affect public order, epidemics or pandemics, any intervention or declaration by Public Administrations (state, regional and local), health institutions or other organizations, both with respect to the prohibition and the recommendation not to celebrate of the festival, as well as any other fact or impediment that does not allow or does not recommend the celebration of the event referred to in these general conditions, as well as any unforeseeable, irresistible event, independent of the will of the organizer and that is beyond its control and that Likewise, it prevents the total or partial execution of the festival, and that cannot be overcome by using medium diligence.
2.6 In the case of ticket refunds, we inform you that only the amount of the ticket will be refunded. Travel, accommodation or any other expense related to the show that you have contracted on your own, is at your own expense and risk, without it being possible to refund these amounts in any case by the ticket seller and/or the promoter of the event. show. In the case of postponement or cancellation of the concert, and without prejudice to the rights recognized by these general conditions, the organizer may offer you a compensation proposal that restores the reciprocity of interests of the contract and constitutes due and reasonable compensation.
In case of postponement, the promoter will not be obliged to return the amount paid. The tickets purchased will be valid for the new date.
2.7 If the cancellation is total, the Promoter will return the amount of the ticket under the conditions that would be published by this same means, with the exception of the distribution cost, as this is a service provided by the sales channels at the time of the purchase and sale of the ticket. Under no circumstances will the amount of the tickets be refunded if the cancellation has occurred once the concert has started.

04. SUSPENSION, CANCELLATION OR ANNULMENT OF THE ACT
4.1. The Organization reserves the right to alter, modify or suspend the NITS DE VIVERS 2024 program at any time.
4.2. In case of total cancellation of NITS DE VIVERS, the Organization will take all possible steps to establish the new dates on which the event will take place.
4.3. In the event that the ticket amount is returned for whatever reason, the distribution cost that the sales channels apply to the ticket price will not be refunded in any case by the Organization, since it is not Preceptor of said amount and that the provision of this service is understood to have been carried out at the time of the purchase of the ticket.
4.4. The total or partial cancellation of NITS DE VIVERS 2024 due to force majeure will in no case lead to a refund of the ticket amount.
4.5. The Festival guarantees the refund of the amount of the tickets purchased , upon request by the buyer within the period set by the Festival , in the event of cancellation or postponement of the Festival for reasons related to a pandemic or infectious disease and due to the restrictions imposed by the competent health authorities
05. RIGHT OF ADMISSION
In application of the provisions of article 33 of Law 14/2010, of December 3, of the Generalitat, on Public Shows, Recreational Activities and Public Establishments of the Valencian Community, the Organization in its capacity as organizer of the NITS DE VIVERS 2024 establishes the following ADMISSION CONDITIONS:
5.1. The organization establishes the following requirements for the access and permanence of those under 16 years of age to the musical and extra-musical activities of NITS DE VIVERS:
I) Minors between 13 and 15 years of age must:
(a) be accompanied by a person of legal age
(b) pay the ticket price that corresponds to the minor
(c) complete by the person of legal age a document provided on the Festival website where they are solely and exclusively responsible for the minor, exempting the Organization from any responsibility and confirming the authenticity of the documentation that is displayed to the Organization. Likewise, and as additional requirements, you must present the Family Book, DNI or passport of the minor, DNI of the adult and, where appropriate, an authorization that must be signed by their father, mother or guardian before the Civil Guard or National Police if they are Spanish people. On the other hand, if the minor is from an EU country or a foreign country, the adult must present all the documentation that proves that he or she is in custody of the minor according to the legislation in his or her country of origin.
II) Children under the age of 12 must (a) be accompanied by their mother, father or guardian and (b) they must complete a document provided on the Festival website where they become sole and exclusive responsible for the minor, exempting of any responsibility to the Organization and confirming the authenticity of the documentation that it exhibits to the Organization. Likewise, and as additional requirements, you must present the Family Book, DNI or passport of the minor and DNI of the mother, father or guardian. On the other hand, if the minor is from an EU country or a foreign country, the mother, father or guardian must present all the documentation that proves that they have the guardianship and custody of the minor according to the legislation in their country of origin. Lastly, minors must carry at all times during their stay at the FIB premises a visible accreditation in which their name and surnames, nationality, in addition to the data of their father/mother/guardian and the mobile number of contact of the latter.
III) The Organization may make photocopies of the documentation exhibited by those of legal age, mother, father or guardian for its filing with prior authorization by the owner and in compliance with current legislation on data protection.
IV) Any minor will be expelled if they consume alcoholic beverages or tobacco.
V) The Organization will expel the minor who fails to comply with the requirements for access and/or permanence in the NITS DE VIVERS, and without this generating any right to refund the amount of the ticket paid.
5.2. The organization reserves the right of admission. Access or permanence in the musical venue, rest area or parking will be denied to Users who in the following circumstances:
I) The ticket or the bracelet has been improperly altered or has signs of fraudulent manipulation.
II) The holder of the ticket or the bracelet has a violent or aggressive attitude, physically or verbally, towards other clients or members of the Festival staff.
III) The holder of the ticket or the bracelet is hindering the normal development of the event or is not following the instructions of the Festival organization staff.
IV) The holder of the ticket or the bracelet, weapons holder or objects that can be used as such.
V) The holder of the ticket or the bracelet shows symptoms of drunkenness or that they are consuming drugs or narcotic substances or show symptoms of having consumed.
VI) Food and drink are not allowed to enter the musical venue, except for 1 bottle of water of 50 cl per person, closed, which will be opened at the access control. In the case of celiac people, access to the venue with food will be allowed as long as there is no offer adapted to these people inside the venue. These people must present access to a valid medical certificate that proves said food intolerance. Access to special children’s food for children up to 3 years of age will also be allowed.
06. INTELLECTUAL PROPERTY AND IMAGE RIGHTS
6.1. The Organization holds and is the owner of all the image and name rights, intellectual and industrial property derived, directly or indirectly, from the artistic presentations or any other that gave rise to the celebration of NITS DE VIVERS 2024 or previous editions. Therefore, the capture, filming or recording of images or sounds without the prior written authorization of the Organization is strictly prohibited.
Therefore, the entry of photo and video cameras and/or recording devices of any kind is prohibited.
6.2. The people attending NITS DE VIVERS 2024 previous editions expressly and unequivocally consent and authorize that their image and voice may be posted on media during the celebration of the aforementioned event and may subsequently be disseminated by the organization or authorized third parties in any media. communication for promotional and/or commercial dissemination of NITS DE VIVERS.
6.3. The Organization will expel any person who fails to comply with the provisions of section 7.1 without generating any right to refund the amount of the ticket paid. 6.4. The attending public consents to their appearance in images taken by any means for subsequent promotional and/or commercial dissemination of NITS DE VIVERS.
07. PERSONAL DATA
7.1. 08. EXCEPTIONAL HEALTH SECURITY MEASURES
IN THE EVENT OF A HEALTH EMERGENCY, THE CONDITIONS OF ACCESS TO THE VENUE MAY BE MODIFIED ACCORDING TO THE COVID HEALTH REGULATIONS IN FORCE ON THE DATE OF THE FESTIVAL.
